Identity of the parties 1.1. These general terms and conditions apply to all agreements and transactions between La Mouette, hereinafter referred to as "the seller," and the user of the website or webshop, hereinafter referred to as "the customer."
Services and products 2.1. The seller offers various products and/or services through the website or webshop. Descriptions of the products and/or services, including prices, payment terms, and any restrictions or conditions, can be found on the website or webshop.
Order process 3.1. The ordering process on the website or webshop involves selecting the desired products and/or services, entering the necessary information for the order, agreeing to these terms and conditions, and completing the payment. 3.2. The seller reserves the right to refuse or cancel an order in the event of insufficient stock, technical problems, or other reasons that make fulfillment of the order impossible.
Liability 4.1 La Mouette is not liable for any damage, direct or indirect, resulting from the use of the fanny pack with holster clip(s). La Mouette accepts no liability for damage to the user's property caused by the use of the fanny pack with holster clip(s).
4.3. The user is responsible for the correct and safe use of the fanny pack with holster clip. It is the user's responsibility to check that the product is suitable for its intended use and to carefully follow all included instructions.
4.4. La Mouette is not liable for any damage resulting from loss, theft, or damage to the contents of the fanny pack with holster clip.
4.5. If La Mouette is held liable despite the above provisions, liability will be limited to the purchase price of the relevant fanny pack with holster clip.
4.6. These limitations of liability do not apply in cases where the exclusion or limitation of liability is not permitted by law.
Intellectual property 5.1. All intellectual property rights relating to the content of the website or webshop, including but not limited to texts, images, logos, and software, belong to the seller or its licensors. 5.2. The customer is not permitted to copy, reproduce, distribute, or otherwise use any material from the website or webshop without the seller's prior written consent.
Privacy and data protection 6.1. The seller processes the customer's personal data in accordance with its privacy statement, which can be found on the website or webshop. 6.2. By using the website or webshop, the customer agrees to the processing of their personal data as described in the privacy statement.
Dispute resolution 7.1. Any disputes between the seller and the customer will initially be settled by mutual agreement. 7.2. If the dispute cannot be resolved by mutual agreement, it will be submitted to the competent court of the seller's place of business, unless mandatory legal provisions prescribe otherwise.
Applicable law 8.1. All agreements and transactions between the seller and the customer are exclusively governed by Dutch law.
Changes to the terms 9.1. The seller reserves the right to amend or supplement these general terms and conditions at any time. 9.2. Changes to the Terms and Conditions will take effect after they are published on the website or webshop. 9.3. It is the customer's responsibility to regularly consult the terms and conditions and to be aware of any changes.
Nullity 10.1. If any provision of these terms and conditions is declared null and void, this will not affect the validity of the remaining provisions. 10.2. In that case, the parties will consult with each other to agree on a replacement provision that most closely reflects the purpose and scope of the invalid provision.
Terms of Use
11.1. The holster clip has a maximum carrying capacity of 5 kg. The user must carefully check the additional safety lock each time it is used.
11.2. The user must regularly inspect the fanny pack with holster clip for any wear or defects. If any wear or defects are found, the user must immediately stop using the product and contact La Mouette.
11.3. La Mouette accepts no liability for damage caused by using the fanny pack with holster clip in violation of the included instructions and guidelines.
By using the La Mouette website or webshop, the customer agrees to these general terms and conditions.
